In brief

  • USCIS has made permanent the end of the automatic extension of up to 540 days for many work permit (EAD) renewals.
  • The final rule was scheduled for publication in the Federal Register on 14 October 2026 and takes effect on publication.
  • It applies to renewal applications filed on or after 30 October 2025; renewals filed before that date keep the old protection.
  • Affected groups include H-4 spouses of H-1B workers, adjustment of status (green card) applicants and asylum applicants.
  • If a renewal is not approved before the current card expires, the worker may have to stop working until it is.

The United States has permanently ended the automatic work permit extension that allowed many immigrants to keep working while their renewal was processed. A final rule from U.S. Citizenship and Immigration Services (USCIS), scheduled for publication in the Federal Register on 14 October 2026, adopts an October 2025 interim rule without any changes.

The rule takes effect on its publication date. For most affected workers, nothing changes in daily practice: the extension already stopped for renewals filed from 30 October 2025. What the final rule removes is any hope that the old system would come back.

Who loses the automatic extension

Before October 2025, renewal applicants in 18 EAD categories could keep working for up to 540 days after their card expired, as long as they filed on time. Under the new rule, these applicants need USCIS to approve the renewal before the current card expires. Main groups include:

  • H-4 spouses of H-1B workers (category C26)
  • Green card applicants with a pending adjustment of status (C09)
  • Asylum applicants (C08), and refugees and asylees (A03, A05)

Spouses of E and L visa holders (A17, A18) were also on the old list, but law firm guidance notes they are authorised to work through their status, so the change affects them less.

USCIS says the change lets it finish security vetting and screening before granting a new period of work authorisation. The rule's own estimate is that 20,000 to 33,000 EADs could lapse over an 18-month period starting May 2027.

What it means for workers

  • A gap in work authorisation is now possible. If USCIS has not approved your renewal by the time your card expires, you may have to stop working until the new card arrives.
  • Employers will re-verify. HR teams cannot accept a receipt notice as proof of continued work authorisation for these categories.
  • Timing is everything. The rule itself notes that the later you file, the more likely a lapse becomes.

Tips to avoid a gap

  1. File early. USCIS generally recommends filing an EAD renewal up to 180 days before the current card expires.
  2. Check the expiry date of every family member's card, especially H-4 spouses whose status depends on the H-1B holder's extension.
  3. Tell your employer early if your renewal is still pending close to the expiry date, so you can plan leave if needed.
  4. Check other bases for work authorisation. Some people, such as certain refugees and asylees, may be authorised to work through their status itself and may need to show other documents.

Frequently asked questions

Is the 540-day EAD automatic extension still available?

Only for renewal applications filed before 30 October 2025. For renewals filed on or after that date, there is no automatic extension, and the final rule published in October 2026 makes this permanent.

Can H-4 spouses keep working while their EAD renewal is pending?

Not after the current EAD expires, if the renewal was filed on or after 30 October 2025. They need the new card approved before the old one runs out.

How early can I file my EAD renewal?

USCIS generally recommends filing a renewal up to 180 days before the current EAD expires.

Does the rule affect TPS holders?

Extensions for TPS-related documents that are announced through Federal Register notices still apply, as do extensions provided by law.
